Terms of Service

1. Account terms

• You must be at least 18 years old to create an account.
• One account per person or business entity. You are responsible for all activity under your account.
• You must provide accurate, current information. Fake email addresses, fraudulent payment details, or impersonation are grounds for immediate termination.
• Keep your password secure. We are not liable for losses caused by unauthorized access to your account that result from your failure to protect your credentials.

2. Acceptable use

You may not use DonePins to:

• Generate pins for products or content that infringe third-party intellectual property rights.
• Create misleading, deceptive, or spam content that violates Pinterest's Community Guidelines or applicable advertising laws.
• Submit Sheets containing harmful, illegal, or hateful content (hate speech, adult content involving minors, etc.).
• Attempt to reverse-engineer, scrape, or abuse the DonePins rendering engine.
• Resell or white-label DonePins services without a written reseller agreement.

Violation of acceptable use may result in immediate account suspension without refund.

3. Subscriptions and billing

• Monthly subscriptions auto-renew on the same day each month. You authorize us to charge your payment method on file.
• Annual subscriptions are billed as a single pre-payment at the start of the term.
• Cancellations take effect at the end of the current billing period. You retain full access until then. We do not prorate refunds for unused days on a cancelled subscription, except as stated in our Refund Policy.
• You can cancel anytime from the customer portal at donepins.com/portal. No phone call required.
• Failed payments result in a retry over 3 days. If payment cannot be collected, your account is paused and orders are held until resolved.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers are locked at their current price until they change plans.

4. One-shot purchases

One-shot orders (single batch, no subscription) are subject to our 5-star or refund guarantee. If your final batch does not earn a 5-star rating from you, we issue a full refund — no questions asked.

5. Intellectual property

• You own your pins. Once delivered and paid for, you hold full commercial rights to every pin generated from your Sheet. Use them anywhere: Pinterest, Etsy, ads, your website, social media.
• We own the engine. The rendering pipeline, AI prompt system, templates, and underlying technology remain our intellectual property. You may not copy, reproduce, or build competing services from them.
• Your Sheet content is yours. By submitting it, you grant us a limited license to process it for the sole purpose of generating your order. We do not retain rights to your source data beyond what is needed for service delivery and support.

6. Service availability

We operate on a best-effort basis and target the turnaround times listed on our Pricing page (24h Starter, 12h Pro, same-day Premium/Whale). These are targets, not guarantees. We are not liable for delays caused by upstream API outages (Anthropic, Vercel, Supabase), force majeure events, or circumstances outside our control.

If we miss a committed turnaround by more than 48 hours for reasons within our control, we will issue a service credit equal to one month of your subscription tier or 50% of your one-shot order.

7. Termination

• You may cancel and close your account at any time from the customer portal. We will process the closure within 5 business days and confirm via email.
• We may suspend or terminate accounts that violate these Terms, engage in fraud, or repeatedly abuse the refund guarantee.
• Upon termination, your access ends immediately. Generated assets remain available for download for 30 days post-termination, after which they are deleted.

8. Limitation of liability

To the maximum extent permitted by law, Digital Empire LLC's total liability for any claim arising from or related to DonePins is limited to the amount you paid us in the 12 months immediately preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or loss of business opportunity, even if we have been advised of the possibility of such damages.

DonePins is provided "as is." We make no warranties — express or implied — about fitness for a particular purpose, merchantability, or uninterrupted availability.

9. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in California.

10. Changes to these Terms

We may update these Terms with 14 days' notice via email or an in-app banner. Continued use after that period constitutes acceptance. If you disagree with a change, cancel before the effective date.
